A prospective borrower gives an MLO her name, monthly income, Social Security number, the address of the house she is buying and the purchase price. She has not yet said how much she wants to borrow. Under TRID, has the creditor received an application that starts the Loan Estimate clock?
For TRID, an application is the submission of six pieces of information: name, income, Social Security number to obtain a credit report, property address, an estimate of the property's value, and the mortgage loan amount sought (12 CFR 1026.2(a)(3)(ii)). The purchase price can serve as the estimate of value, but it is not the loan amount she wants. Until all six are in hand, the three-business-day Loan Estimate deadline has not started. Treating the purchase price as the loan amount sought, so the six-item test looks complete when it is not.
