Failed the NMLS Test? Retake Rules and Waiting Periods
Failing once is common. The SAFE Act sets the waiting periods (12 U.S.C. 5104(d)(3)(B)-(C); 12 CFR 1008.105(e), as at 11 Oct 2026).
| Attempt | Wait before the next attempt |
|---|---|
| After the 1st failure | At least 30 days |
| After the 2nd failure | At least 30 days |
| After the 3rd consecutive failure | At least 6 months |
Each attempt requires a new enrollment and fee.
Using the 30 days
- Look at your score report by section and rank your weakest areas.
- Re-drill those topics with applied questions and read the study notes for each.
- Take at least two full timed practice exams before rebooking.
- Fix timing: aim for about 1.5 minutes a question with 15 minutes left to review.
The 5-year rule
Once you pass, you do not retake the test unless you go 5 years or more without a valid license, not counting time as a registered loan originator (12 U.S.C. 5104(d)(4)).
